Safechecker provides online background verification services that enable users to perform background checks on individuals for various purposes, including but not limited to employment, tenant, and volunteer verification.

3.1. In order to access certain features of the Services, you may be required to create a user account.

3.2. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.3. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3.4. You agree to notify Safechecker immediately of any unauthorized use of your account or any other breach of security.

4.1. You may use the Services to verify the backgrounds of individuals for legal purposes only.

4.2. Safechecker does not guarantee the accuracy or completeness of information obtained through background verifications, as such information may come from third-party databases.

4.3. You agree to use information obtained through background verifications in compliance with all applicable laws and regulations, including but not limited to those relating to consumer information and privacy.

5.1. Use of certain features of the Services may require payment of fees.

5.2. You agree to pay all fees associated with your use of the Services in accordance with the pricing and payment terms provided to you by Safechecker.

5.3. All fees are non-refundable unless otherwise stated in writing by Safechecker.

5.4. Unless expressly stated otherwise, all amounts and payments contemplated under this agreement are denominated in United States dollars (USD), to ensure a stable and uniform monetary unit for all international transactions.

6.1. The collection and use of personal information by Safechecker is governed by its privacy policy, which is incorporated into these Terms by reference.

6.2. By using the Services, you consent to the collection, use, and disclosure of your personal information in accordance with the privacy policy.

7.1. All intellectual property rights in the Services, including but not limited to copyrights, trademarks, and trade secrets, are owned by Safechecker or its licensors.

7.2. You are granted a limited, non-exclusive, non-transferable license to use the Services for internal business purposes only.

8.1. THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED.

8.2. SAFECHECKER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9.1. SAFECHECKER SHALL IN NO EVENT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF THE SERVICES, EVEN IF SAFECHECKER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9.2. SAFECHECKER'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO SAFECHECKER DURING THE TWELVE-MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO SUCH LIABILITY.

You agree to indemnify, defend, and hold harmless Safechecker and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with your use of the Services or any violation of these Terms.

Safechecker reserves the right to modify these Terms at any time. Any modification will be effective immediately upon posting of the revised Terms on the Safechecker website. Your continued use of the Services after the posting of the revised Terms constitutes your agreement to the revised Terms.

These Terms are governed by and construed in accordance with Canadian law, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of Canada.
